1. Description of Service

Xpensim is an expense tracking and balance forecasting tool. It lets you create accounts, define recurring income and expenses, project future balances, import statement data, and share accounts with other users. The service is provided for personal financial planning purposes.

2. Eligibility

You must be at least 18 years old to use Xpensim. By creating an account or using the service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms. Xpensim is not intended for, and may not be used by, anyone under 18.

3. Accounts and Your Responsibilities

You may use Xpensim as a guest or register as a member. When registering, you agree to provide accurate information and to keep your credentials secure. You are responsible for:

• All activity that occurs under your account
• Keeping your password and login codes confidential
• Notifying us promptly at contact@xpensim.com if you suspect unauthorized access
• The accuracy of the financial data you enter — Xpensim does not verify it

Guest accounts may be converted to member accounts at any time.

4. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to the service, other users' accounts, or our systems.
• Interfere with or disrupt the service or the servers and networks it depends on.
• Use automated means (scraping, bots, stress tools) to access the service without our prior written permission.
• Reverse engineer, decompile, or attempt to extract the source code of the service.
• Use the service to store, transmit, or process any data you do not have the right to handle.

5. Your Data and Privacy

You retain ownership of every record, value, and account you enter. How we collect, use, and protect your data is described in our Privacy Policy. Please review it — it explains what we do and do not do with your data.

6. Subscription Plans and Billing

Xpensim offers a free Basic plan and a paid Pro plan. The current features and pricing of each plan are shown in the app.

• Automatic renewal. Pro subscriptions renew automatically at the end of each billing period (monthly or yearly) unless you cancel beforehand.
• Cancellation. You may cancel at any time from the app. Pro features remain active until the end of your current billing period; no partial refunds are issued for the unused portion.
• Price changes. We may modify plan features and pricing. Changes take effect at your next renewal, and we will give you reasonable advance notice — you may cancel before the change takes effect if you do not accept it.
• Taxes. Stated prices do not include taxes, which may be added based on your location.
• Payment processing. Payments are handled by our third-party payment provider. Your card details go directly to them; we do not store payment details.

7. Not Financial Advice

Xpensim is a planning and forecasting tool, not financial advice. Xpensim is not a bank, broker, financial institution, investment adviser, accountant, tax professional, or fiduciary of any kind. We do not provide financial, investment, tax, legal, or accounting advice.

Projected balances are estimates based entirely on the data you enter and the formulas you configure. They are not guarantees and may not reflect what actually happens. You should not rely on Xpensim alone for any financial decision. For professional advice, consult a qualified adviser.

8. Disclaimer of Warranties

The service is provided "as is" and "as available", without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties — including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation. We do not warrant that projections, calculations, imports, or exchange-rate conversions will be accurate, complete, or suitable for any specific use.

9. Limitation of Liability

To the fullest extent permitted by applicable law:

• Xpensim and its operators, affiliates, officers, and service providers are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including (without limitation) loss of profits, revenue, data, goodwill, or financial opportunity, arising out of or relating to your use of the service — even if we have been advised of the possibility of such damages.
• Our total aggregate liability for all claims arising out of or relating to the service, regardless of the cause of action, is limited to the greater of (a) the amount you paid us for the service in the twelve (12) months immediately before the event giving rise to the claim, or (b) $0 if you are a free-plan user who has paid nothing.

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you. In those cases, our liability is limited to the smallest amount permitted by applicable law.

10. Account Termination

You may delete your account at any time through the Member Profile page. Deletion is immediate and permanent — everything associated with your account is removed from our active systems (see the Privacy Policy for details on backup retention), and any active subscriptions are cancelled. Once deleted, your data cannot be recovered. We recommend exporting any data you want to keep before deleting.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used to harm the service, other users, or third parties. Where practical, we will give advance notice; we may act immediately in cases of security risk, abuse, or legal requirement.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws principles. You agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada for any dispute arising out of or relating to these Terms or the service, except where applicable consumer-protection law in your jurisdiction grants you the right to a local forum.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the service after changes take effect constitutes acceptance of the updated Terms. We will make reasonable efforts to notify users of significant changes and update the "Last updated" date at the top of this page. If you do not accept a change, your remedy is to stop using the service and delete your account.
